EISDEV Consulting Limited Liability Company

1. Introduction

These Terms and Conditions ("T&Cs") set out the basic terms for the use of the foglalok.ai system (the "System") developed and operated by EISDEV Consulting Ltd. (the "Provider"). The purpose of the System is to provide appointment booking and customer management functionality to businesses using the System (the "Customer"), and to the Customer's clients (the "Clients").

3. Definitions

Capitalized terms used in these T&Cs shall be interpreted consistently with the definitions in the Provider's Privacy Policy, available here: Privacy Policy.

4. Scope and operation of the System

The Provider offers an online customer management and appointment booking solution for Customers. The System may be used via a web interface and via messaging channels connected to the System (for example, Facebook Messenger).

5. Contracting and access

A contract for the use of the System between the Provider and the Customer is concluded based on an individual agreement. Access rights, user accounts, and service parameters are configured according to the parties' agreement.

6. Fees and payment

Fees payable for using the System are defined in the individual agreement between the Provider and the Customer. The Customer shall pay the fees in accordance with the agreed terms and deadlines.

7. Responsibilities of the Customer and Clients

The Customer is responsible for its own business activity, the provision of its services, the rules of bookings (including cancellation rules and any fees), and for providing information to its Clients. The Provider only ensures the technical operation of the System.

The performance of a booked appointment is part of the legal relationship between the Customer and the Client; the Provider is not a party to that relationship.

8. Cancellations, modifications, availability

Rules for cancelling or modifying bookings are determined by the Customer. The Provider aims to ensure continuous availability of the System; however, the Provider may temporarily suspend the service due to maintenance, improvements, or force majeure.

9. Liability

The Provider shall not be liable for claims arising from the legal relationship between the Customer and the Client, including the quality, delay, non-performance, or performance of the Customer's services. The Provider shall not be liable for damages resulting from improper use of the System or unlawful conduct by third parties.

10. Data processing

The Provider processes personal data as described in the Privacy Policy. The Customer acknowledges that, in the relationship between the Customer and its Clients, the Customer may act as an independent controller under applicable law.

11. Complaints and contact

Feedback and complaints regarding the operation of the System can be submitted using the Provider's contact details above.

12. Governing law and final provisions

These T&Cs shall be governed by Hungarian law. The Provider may unilaterally amend these T&Cs; the amended version becomes effective upon publication on the website.
